A former finance manager has been found guilty of overseeing a multi-million dollar Ponzi scheme targeting the Japanese community.
Yuko Hanyu was found guilty at the Auckland District Court yesterday afternoon on numerous charges related to her time at East Wind Company Limited, which was part of the East Wind Group.
The company marketed itself as offering financial services and immigration support to New Zealand's Japanese community.
The group collapsed and was placed into liquidation in 2019 following the death of its director, Masatomo Ashikaga (also known as Tom Tanaka).
Financial products offered by the company – including the Group Term Deposit and Waterloo Fund – operated as Ponzi schemes, a type of fraud in which existing investors are paid using money from new investors lured by ‘get rich quick’ promises. There is normally no investment scheme, and the fraudsters siphon off the money for themselves.

Hanyu had served as the company's finance department manager from 2004 until December 2017.
She and Ashikaga worked together to obtain funds from investors, using false statements about their financial products and promised returns.
In reality, there were no legitimate investments, and the funds were used to repay other investors.
Hanyu had also made unauthorised payments of over $400,000 from the East Wind accounts to her mortgage account and over $430,000 to her personal credit card.
In court, she faced four representative charges of false statement of a promoter, two representative charges of obtaining by deception, one charge of theft by a person in a special relationship, and three representative charges of theft for stealing more than $800,000 from East Wind.
“This was an incredibly complex case involving the analysis of substantial, detailed financial records, many of which were in Japanese, and a large number of mostly overseas-based investors," Serious Fraud Office director Karen Chang said.
“Ms Hanyu and Mr Ashikaga exploited their connections to the Japanese community to deceive investors out of millions of dollars. Many of the investors did not get their money back."

A jury found Hanyu guilty of making false statements as a promoter in the "investment products".
She was found guilty as a party to a charge involving more than $6.5 million in new investments in the Group Term Deposit product and as the principal offender in relation to a charge involving more than $12.5 million in reinvestments.
Hanyu was found guilty of using $1 million to repay one of the Waterloo Fund investors, money that should have been invested in another scheme offered by the company, the Restaurant Fund.
She was also found guilty of three charges of theft.
Two were for transferring around $430,000 from East Wind’s company accounts to her personal credit card. The other related to more than $400,000 she arranged to be paid into an account associated with her mortgage.
She will be sentenced on July 3.
“Offending such as this threatens New Zealand’s reputation as a safe place to do business, undermines legitimate investment markets and dissuades foreign investors from putting their money into our economy," Chang said.

オークランドの地裁（Auckland District Court）自体は、環境客がよく集まる賑やかなクイーン通り（Queen street。谷になっています）の１つ（距離にして200ｍほど）山側と言うか、西側に走っている通り（Albert St.と言います。Windham St.とクロスしていますが、双方を目印に探して行けば、たどり着けます）にあります。国際空港からは、市街地としてSky Towerの下にバス（片道NZ＄２０。１NZ＄は、６～７年前から大分、円安傾向に触れましたが、今は¥93ほど。円は勿論、米ドルは使えないので、空港か市街に３～４個ある両替所（やはり、Queen通りに集中）で替えることが必要です）が着きますが、そこから、十分歩いて行ける距離です。
もっとも、オークランドは、何処もかしこも、急坂が多いので、やや移動に体力が要りますが。
もちろん、¥１．５万前後/泊の個室のホテルもあるにはありますが。
９月の２６日（土）までは、３時間だけ、時計が進んでいます（ＮＺの方が＋３ｈ）が、２７日（日）の午前２時からは夏時間になって、さらに１時間進む（ＮＺの方が＋４ｈに）ので、外出・約束・帰国の際にはご注意ください。
まだ、９/２４が延びるのか、そのままなのか不確定ですが、何れにしても、

例えば、週末と日本の連休１９（土）~２３日（水）を外す取り方、例えば１８日（金）に発って、２８日（月）に向こうを出ると言うようなチケットの取り方をしても、長めに滞在出来る分、オーランドで、E.W.周りで数年前、何が起こっていたかのリサーチはある程度は自分の足で出来るものの、双方¥１万しか安くなりませんね。
オークランドは、日本語だと同じ発音になりますが、ニュージーランドのもの（スペル：Auckland [ˈɔːklənd] ）と、もう１つは米国のサンフランの近く（スペル：Oakland [ˈoʊklənd] ）があります。
空港の記号は、NZの方がAKLで、米国の方はOAKです。
両方、国際空港を持っているので、行かれる方は、サイトによっては、米国の方が優先的に出る場合もあり、値段自体が、そう大きく変わらないので、取り間違えされないでください。
他の方はこの上記１５行くらいの箇所に、驚かれませんでしたか？
つぶさに、法廷の現場で、被告・裁判官・検察、そして証人間の
やり取りをつぶさに観察していないと、知り得ないことでもあるのですが、
それは、裁判での犯罪への一定の心象形成の流れとして、
当初のNew Zealand Herald等の報道の見たて
（元社長：トム田中＋妻：サンディ＝主犯、羽生優子＝従犯）とは違い、
逆に、羽生が寧ろ主犯、トム田中とサンディが遣い込みの事象をそう知らなかった従犯であり、
彼らは、ことの申告さを知った時点で、
犯罪がこれ以上大きくなるのを止めにかかっていたと言う構造です。
裁判所からも被告や証人からの陳述の内容は送ってもらおうとは、思っていますが、
これは、犯人の主従がひっくり返るのは大きなことで、
どうして、「トム田中夫婦は、社内で、羽生優子が酷いことをしている」
と訴えようとしていた、と分かったのかが興味があります。
ひょっとしたら、証拠隠滅し事件自体を揉み消そうとした羽生に
何ら、同情する積りはありませんが、ひょっとして、これを検察（SFO）側から指摘された時、
感情的になり、量刑のdisclosureを延ばそうとしていると言うことは、
「そんな事、違う！」と、今回、自分側の「いや。自分はトムとサンディの指示を聞き、
自由自在に社内のお金を自分の生活費用に使っていい、と言っていたので、そうしただけ」を正当化する、
第３者の証人を音声か指示書付きで、自分の刑を軽くするために出して来ようとしているのかも
しれませんね。
あと、疑義は、このサンディや足利が「目減りしてるじゃないか。。。」と言うことで行なった、
カネの巡りの自社調査と、
彼らが最終的に羽生が遣い込みの主犯と確定させた時期と、
トム田中が風呂で死んだ時期、それにサンディが胃がんにかかった時期
（後に、施設で死亡と）の時間の前後関係がどうなっているのか？とか、
元々、トム田中/サンディ.夫婦と羽生との仲はよくなかった？それとも信頼歓喜を構築し良好だった？
と言うことかと思います。
また、これまでの大きなニュースなのに、自社の記事でHeraldが騒いでないことを思うと、
報道機関は、法廷に今回、来なかったのかもしれませんね。
何れにしても、トム田中・サンディ・羽生。自浄能力はなかった訳で、
公益通報も大きな声で発していなかったと言うことからも、３者、皆。悪党には変わりないかと。

明日予定されていた羽生優子氏の公判は、延期されることが決定したそうです。(第三者による報告書を準備するための時間が認められたということです。)
新たな公判期日が決まり次第、被害者の方々には、SFOから連絡があるということです。

先般の賠審裁判で有罪となった羽生優子氏に量刑を言い渡す公判が、以下の通り予定されています。
日程 2026年7月3日（金）午後2時15分
場所 オークランド地方裁判所 Auckland District Court

＊公判の傍聴はどなたでも可能です。
ただし先日、この公判を延期してほしいという要請が羽生氏側からあったそうです。有罪判決に対する異議申し立てをするとともに、第三者による報告書の作成を行うためということです。
検察側はこの延期申請に反対していますが、裁判官は公判を延期することに同意する可能性があるようです。
このため、予定通りに公判が行われるかどうかまだ確定していません。確定次第、被害者の方々にはSFOから連絡があるそうです。

”日本人コミュニティを標的としたポンジ・スキームを主導した女性、有罪判決”

元財務マネージャーが、日本人コミュニティを標的とした数百万ドル規模の
ポンジ・スキーム（いわゆる、ネズミ溝）を主導した罪で有罪判決を受けた。
つまり、羽生優子被告が昨日（４/１３）午後、オークランド地方裁判所において、イースト・ウィンド・グループ傘下のイースト・ウィンド・カンパニー・リミテッド在籍中に起因する多数の罪状について有罪判決を受けたのである。
同社は当初、ニュージーランド在住の日本人コミュニティ向けに金融サービスや移民支援を提供していると宣伝していた。
同グループは、代表取締役社長であった足利正友（別名：トム・タナカ）の風呂場での死去を受け、
2019年に破綻し、清算手続きに入った。
その時点で明らかになったこととして、
同社が提供していた金融商品（「グループ定期預金」や「ウォータールー・ファンド」など）は、ポンジ・スキームとして運営されていた。これは、「一攫千金」の謡いで同社に誘い込まれた新規投資家からの資金を使って、
既存の投資家に支払いを行う詐欺の一種である。
従来、この事件では、実際の投資スキームは存在せず、詐欺師たちは資金を横領して私腹を肥やしていた。
その実、
羽生氏は2004年から2017年12月まで、同社の財務部門マネージャーを務めていた。
彼女と足利は、金融商品や約束された収益について虚偽の説明を行い、投資家から資金を集めるために共謀した。
先記のように、
正当な投資対象は実際には存在せず、集めた資金は他の投資家への返済に充てられていた。
また、羽生はイースト・ウィンドの口座から、
自身の住宅ローン口座へ40万ドル以上、個人のクレジットカードへ43万ドル以上を無断で振り込んでいた。
法廷では、彼女はイースト・ウィンドから80万ドル以上を横領したとして、プロモーターによる虚偽陳述の代表的罪状4件、
詐欺による取得の代表的罪状2件、特別関係にある者による窃盗の罪状1件、および窃盗の代表的罪状3件で起訴された。
「これは、その多くが日本語で記された膨大かつ詳細な財務記録の分析や、主に（ニュージーランド以外の）海外在住の
多数の投資家が打撃を受けた、極めて複雑な事件でした」と、重大詐欺局（SFO）のカレン・チャン局長は述べた。
彼は
「羽生氏と足利氏は、日本人コミュニティとのつながりを悪用して、投資家から数百万ドルを騙し取っていた。
多くの投資家は、自分が投資した資金を未だ回収できていません。」
とも言った。
こう言う背景により、陪審員は、羽生被告が「投資商品」の勧誘者として虚偽の陳述を行った罪で有罪と認定した。
彼女は、所謂「グループ定期預金」商品への新規投資650万ドル超に関する罪の共犯者として、
また、1,250万ドル超の再投資に関する罪の主犯としても有罪とされた。
同時に羽生被告は、新規顧客から得た100万ドルを、他の既存の顧客への返済に充てた罪で有罪とされた。
さらに、同被告は、同社が提供する別の投資スキーム「レストラン・ファンド」に投資されるべきだった100万ドルを、ウォータールー・ファンドの投資家の一人への返済に充てた罪でも有罪判決を受けた。
別途、彼女は窃盗罪3件についても有罪判決を受けた。
そのうち2件は、顧客から集金済みに特化したイースト・ウィンド社の口座から自身の個人クレジットカードへ約43万ドルを振り替えたことに関するものであった。
もう1件は、彼女が自身の住宅ローンに関連する口座へ40万ドル以上を振り込ませたことに関するものであった。
ただ、今の４月の時点では、陪審員や裁判所が、「イーストウィンド事件に関し、羽生優子が有罪か無罪かの判断を下した
（つまり、事件全体の事実認定と、有罪/無罪の結論を出した）」と言うことであり、羽生が罪状に照らし合わせて、懲役何年か無期懲役なのか？あるいは禁固なのか？は決まってはおらず、
その詳細の羽生への刑の中身が宣告される方の判決は、7月3日に言い渡される予定である。
（海外では、裁判の場合、多くの国では、日本のように、有罪か無罪かの同定と、
被告の刑の重軽が同時に言い渡されることは稀であるので、そう言う日程の段取りになっている）
「このような犯罪行為は、ビジネスを行う上で安全とされていたニュージーランドの評判を脅かし、
正当な投資市場を損ない、外国人投資家が我々の経済に資金を投入する事を思い留まらせることになる」

A former finance manager has been found guilty of overseeing a multi-million dollar Ponzi scheme targeting the Japanese community.
Yuko Hanyu was found guilty at the Auckland District Court yesterday afternoon on numerous charges related to her time at East Wind Company Limited, which was part of the East Wind Group.
The company marketed itself as offering financial services and immigration support to New Zealand's Japanese community.
The group collapsed and was placed into liquidation in 2019 following the death of its director, Masatomo Ashikaga (also known as Tom Tanaka).
Financial products offered by the company – including the Group Term Deposit and Waterloo Fund – operated as Ponzi schemes, a type of fraud in which existing investors are paid using money from new investors lured by ‘get rich quick’ promises. There is normally no investment scheme, and the fraudsters siphon off the money for themselves.

Hanyu had served as the company's finance department manager from 2004 until December 2017.
She and Ashikaga worked together to obtain funds from investors, using false statements about their financial products and promised returns.
In reality, there were no legitimate investments, and the funds were used to repay other investors.
Hanyu had also made unauthorised payments of over $400,000 from the East Wind accounts to her mortgage account and over $430,000 to her personal credit card.
In court, she faced four representative charges of false statement of a promoter, two representative charges of obtaining by deception, one charge of theft by a person in a special relationship, and three representative charges of theft for stealing more than $800,000 from East Wind.
“This was an incredibly complex case involving the analysis of substantial, detailed financial records, many of which were in Japanese, and a large number of mostly overseas-based investors," Serious Fraud Office director Karen Chang said.
“Ms Hanyu and Mr Ashikaga exploited their connections to the Japanese community to deceive investors out of millions of dollars. Many of the investors did not get their money back."

A jury found Hanyu guilty of making false statements as a promoter in the "investment products".
She was found guilty as a party to a charge involving more than $6.5 million in new investments in the Group Term Deposit product and as the principal offender in relation to a charge involving more than $12.5 million in reinvestments.
Hanyu was found guilty of using $1 million to repay one of the Waterloo Fund investors, money that should have been invested in another scheme offered by the company, the Restaurant Fund.
She was also found guilty of three charges of theft.
Two were for transferring around $430,000 from East Wind’s company accounts to her personal credit card. The other related to more than $400,000 she arranged to be paid into an account associated with her mortgage.
She will be sentenced on July 3.
“Offending such as this threatens New Zealand’s reputation as a safe place to do business, undermines legitimate investment markets and dissuades foreign investors from putting their money into our economy," Chang said.

今年2月9日から2ヶ月間以上にわたって行われてきた陪審裁判の結果、イーストウィンドの財務マネージャーだった羽生優子氏の有罪が確定しました(4月13日)。
判決は7月3日に言い渡されるとのことです。

２月９日から、オークランド地方裁判所で始まった
NZイーストウィンド EAST WIND社の
元財務部門責任者・羽生優子氏に対する陪審裁判に、評決が出ました。
NZ重大詐欺捜査局 SFO（The Serious Fraud Office）より、

羽生優子氏の裁判は3月20日までということでしたが、あと1週間ほど（あるいはもう少し）、さらに時間を要するようです。
現在は、証人の証言に対する弁護側の反対尋問が行われている、ということです。
